NOTICE: EFFECTIVE FEBRUARY 01, 2005, THE TEMPORARY SPECIAL
VISA FOR MARRIAGE IN COLOMBIA BY A FOREIGN CITIZEN IS NO
LONGER REQUIRED BY THE CIVIL NOTARIES OR COLOMBIAN CONSULATES UNDER AT LEAST THREE (3) LEGAL DOCUMENTS:
1) DECREE NO. 4000 OF 2004 (COLOMBIAN LEGISLATURE),
2) ADMINISTRATIVE INSTRUCTION NO. 1 OF 2005 (SUPERINTENDENT OF NOTARIES) AND
3) PUBLISHED COMMUNIQUE NO. 3 OF 2005 (MINISTRY OF FOREIGN RELATIONS).

*U.S. Citizens can now marry in Colombia under any valid and unexpired visa, including the standard tourist visa which is the stamp of typically 30 to 60 days in the U.S. Passport when processing through D.A.S. SUBJECT: NEW DISPOSITIONS REGARDING ISSUANCE OF VISAS

Dear Notary:

On the first day of February of this year, Decree 4000 of 2004 will go into effect which dictates new rules or dispositions regarding the issuance of visas, control of foreign citizens and other matters concerning migration.

As you know, under previous Decree 2107 of 2001, this Superintendent Office was required to instruct you notaries about the establishment of a temporary special visa for marriage for a foriegn citizen who wishes to enter our national territory for the purpose of concluding a marriage.

In the past, there was a need and requirement that the foreign citizen present a temporary special visa for marriage as a requirement for marriage before a notary.

Now, Dr. Carlos Ivan Plazas Herrera, Coordinator of Visas and Immigration of the Ministry of Foreign Relations has told this Superintendent Office that the temporary special visa for marriage is discontinued: "This category of visa under Decree 4000 of 2004 is eliminated, and hereafter no specific visa is required for marriage of a foreign citizen except a visa, valid and unexpired, of any category or class allowing entry into the country and properly issued by the Department of Administrative Security. This rule permits me to ask you, the Superintendent Office, which is a change from Circular No. 02-02 of January 03, 2002, to instruct the Notaries of the country not to require a foreign citizen who wants to marry in Colombia to show any special visa."

In accordance with the above, we ask that you the Notary relinquish any requirement for a temporary visa for marriage for a foreign citizen who is coming before you to marry.

INSTRUCCION ADMINISTRATIVA NO. 1 DE 2005

ASUNTO: NUEVAS DISPOSICIONES SOBRE EXPEDICION DE VISAS

FECHA: ENERO 2005

Apreciado Notario:

El Primero de Febero de presente año entrara en vigencia el Decreto 4000 de 2004, por el cual se dictan disposiciones sobre la expedicion de visas, control de extranjeros y otras disposiciones en materia de migracion.

Como Usted sabe bajo la vigencia de las disposiciones anteriores, Decreto 2107 de 2001, esta Superintendencia debio instruir a los notarios sobre el establecimiento de una visa temporal especial que servia a los extranjeros que querian entrar al territorio nacional para entre ortos casos, contraer matrimonio.

De la anterior manera la necesidad y requerimiento por Usted de la visa temporal especial se volvio un requisito mas para los matrimonios y cual quedaban sometidos los extranjeros que quiseran contraer nupcias en Colombia por el procedimiento notarial. Por lo anterior el doctor Carlos Ivan Plazas Herrera, Coordinador del Grupo de Visas e Inmigracion del Ministerio de Relaciones Exteriores, ha dicho a esta Superintendencia, refiriendose a las derogadas visas temporales especiales para matrimonio: "Por lo cuanto esta categoria de visa no fue consagrada en el Decreto 4000 de 2004, es decir que a partir de su vigencia, para que una visa especifica sino que lo podra hacer con cualquir categoria o clase de visa, asi como con el permiso de ingreso y permanencia expedido por el Departamento Administrativo de Seguridad, muy comedidamente me permito solicitarle al señor Superintendente que, con fundamento en lo expuesto anteriormente, se derogue la Circular No. 02-02 del 3 de Enero de 2002, por medio de la cual se instruye a los notarios del pais acerca de la clase de visa que es idonea para que un extrajero pueda contraer matrimonio en Colombia, asi como se relacionan aquellas cuyo titular puede realizar dicho acto y las que no le permiten hacerlo."

De acuerdo a las consideraciones anteriores le ruego senor Notario dejar de exigir, a los extranjeros que vayan a contraer matrimonio ante Usted, la visa temproal especial para matrimonio.

3) PUBLISHED COMMUNIQUE NO. 3 OF 2005 (ENGLISH)

The procedures for foreign citizens who desire to marry in the country are condensed here:

*Since the First of February 2005, foreigners who desire to marry in the country are not obligated to obtain any special visa for this purpose.

*This is under a communique to 839 public notaries in the country, Administrative Instruction No. 1 of 2005 written by Superintendent Mnauel Guillermo Cuello Baute.

*Under this official´s communication and with the passage of Decree No. 4000 of 2004, a foreigner who desires to marry before any notary does not require a special visa but can utilize any category or class of valid visa which allows entry (into Colombia) and is properly issued by Department of Administrative Security.

*Since Year 2001, persons from other nations who desired to change their civil marriage status in Colombian territory were required to present a temporary special visa, among other things, which was the normal process.

*It is important to note that the Decree No. 4000 of 2004 cited above is a regulation which governs issuance of visas, control of foreigners and other matters of migration.

COMUNICADO DE PRENSA N° 3 DE 2005

Se reducen trámites a extranjeros que deseen casarse en el país

¤ Desde el primero de febrero, los extranjeros que deseen contraer matrimonio en el país no se verán obligados a tramitar una visa especial para este fin.

¤ Así fue comunicado a los 839 notarios del país, mediante la Instrucción Administrativa N° 01 de 2005, suscrita por el Superintendente del ramo, Manuel Guillermo Cuello Baute.

¤ Según el funcionario, con la entrada en vigencia del Decreto 4000 de 2004, a partir del mes entrante, el ciudadano extranjero que desee contraer matrimonio en cualquier notaría de nuestro país, no requerirá de una visa específica sino que lo podrá hacer con cualquier categoría o clase de visa, así como con el permiso de ingreso y permanencia expedido por el Departamento Administrativo de Seguridad.

¤ Desde el año 2001, las personas provenientes de otras naciones que deseaban cambiar de estado civil en territorio colombiano debían presentar una visa temporal especial para, entre otros casos, adelantar este trámite.

¤ Es importante señalar que el Decreto en mención regulala expedición de visas, control de extranjeros y otras disposiciones en materia de migración.
